The short version. Install PingStock on your Shopify store, set thresholds, get pings. Billing runs through Shopify. Either side can end the agreement at any time. PingStock is a monitoring tool, not a guarantee — we'll do our best, but our liability is capped. Indian law governs.
01 Who's agreeing to what
These Terms form a binding agreement between Blossomn Studio (an independent product studio based in Bengaluru, India — referred to here as "we", "us", "PingStock") and the merchant whose Shopify store has installed the PingStock app ("you", "your store").
By installing PingStock, you accept these Terms and our Privacy Policy. If you don't accept them, uninstall the app — that's the cleanest way to opt out.
02 What PingStock does
PingStock is a Shopify app that monitors inventory levels across your store and delivers alerts ("pings") to the people and channels you nominate when a SKU crosses a threshold you've set. Features available to your store depend on the plan you're on; the pricing page lists what's included in each.
03 Your account & your responsibilities
- You're responsible for keeping your Shopify login secure. PingStock authenticates through Shopify's OAuth — we never see your password.
- You're responsible for the contact details (emails, Slack workspaces) you add as recipients. You confirm that you have the right to send PingStock alerts to those addresses.
- You're responsible for the thresholds and routing rules you configure. PingStock will faithfully execute them; it won't second-guess them.
04 Billing & Shopify as merchant of record
Paid PingStock plans are billed through Shopify's billing system. Shopify is the merchant of record for these charges. You'll see PingStock charges on your regular Shopify bill, governed by Shopify's billing terms in addition to these.
Subscription fees are charged in 30-day cycles, recurring until you cancel. We may change pricing with at least 30 days' notice to the install owner; if you don't accept the new pricing, uninstall before the next cycle and you won't be charged again.
Free trials, if offered, convert to paid at the end of the trial unless you cancel inside the trial window.
05 Refunds
Refund requests for PingStock subscriptions go through Shopify's billing support — Shopify processes the refund since they took the payment.
We will, in good faith, approve any refund request for a subscription period during which PingStock had a sustained outage on our side, or where the app was billed in error. Email info@blossomn.com with the relevant Shopify charge ID and we'll handle it.
06 Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract PingStock's source code beyond what Indian copyright law expressly permits.
- Use PingStock to harvest contact information for unrelated marketing — recipients must be people you have a legitimate operational reason to ping.
- Use PingStock to send abusive, deceptive, or illegal content via the channels we route.
- Attempt to disrupt our infrastructure (load testing, DDoS, abuse of any endpoint, etc.) without prior written agreement.
- Resell or sublicense PingStock to third parties without a written reseller agreement.
We may suspend or terminate accounts that violate these rules, with notice where practical and immediately where the abuse is ongoing.
07 Service availability & "best effort"
PingStock is a monitoring tool. We work hard to keep it always-on, but we don't guarantee uninterrupted availability of either the app or any individual ping. Inventory data comes from Shopify; channel delivery depends on third parties (Postmark for email, Slack for channel pings).
Your inventory decisions remain your own. A missed or delayed ping does not by itself create a claim against us for the consequences — the underlying source of truth is your Shopify store.
08 Data & privacy
How we handle the data your store sends through PingStock is described in the Privacy Policy, which forms part of these Terms. The short version: we read only what we need, we don't sell or share, we don't train models on your data, and we delete it on uninstall.
09 Intellectual property
PingStock — including the app, the brand, the documentation, and the website — is owned by Blossomn Studio. You get a limited, non-exclusive, non-transferable license to use it for your Shopify store while your subscription is active.
Your store's data — products, inventory, recipient list, configuration — remains entirely yours. We act on it; we don't own it.
10 Warranties & disclaimer
To the maximum extent permitted by Indian law, PingStock is provided "as is" and "as available". We make no warranty that the service will be uninterrupted, error-free, or that any particular ping will arrive within a particular time.
Statutory consumer rights under Indian law that cannot be lawfully excluded remain in force regardless of this clause.
11 Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with these Terms — whether in contract, tort, or otherwise — is capped at the greater of:
- ₹10,000 (ten thousand Indian rupees); or
- the total subscription fees you paid to us for PingStock in the three (3) months immediately preceding the event giving rise to the claim.
Neither party is liable to the other for indirect, incidental, consequential, or punitive damages — including lost profits, lost sales, or the commercial consequences of stockouts — even if advised of the possibility.
12 Termination
- You can leave any time by uninstalling PingStock from your Shopify admin. Billing for the current cycle is not pro-rated; we don't claw back access mid-cycle.
- We can terminate for material breach of these Terms (e.g. ongoing abuse) with notice, or immediately where the breach is serious.
- On termination, the deletion process described in §08 of the Privacy Policy kicks in.
13 Changes to these terms
If we update these Terms in a way that materially changes your rights or obligations, we'll email the install owner before the change takes effect. Continued use of PingStock after the effective date counts as acceptance; if you'd rather not accept, uninstall before then.
14 Governing law & disputes
These Terms are governed by the laws of India. Any dispute arising out of or in connection with PingStock will be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
Before escalating to a court, both sides agree to make a genuine attempt to resolve the matter by email and, if needed, a video call. Most things are fixable with a conversation.
